Apex Mayor Keith Weatherly called the meeting to order at 5:00 p.m.  Committee members attending were Cary Mayor Harold Weinbrecht, Holly Springs Mayor Dick Sears, Apex Town Manager Bruce Radford, and Cary Town Manager Ben Shivar.  Committee members absent were Morrisville Mayor Jan Faulkner, Morrisville Town Manager John Whitson, and Holly Springs Town Manager Carl Dean.  The meeting adjourned at 6:10 p.m.

 

A. Approval of minutes of the Policy Advisory Committee held on March 5, 2009.

            Mayor Sears moved to approve the minutes, Mayor Weinbrecht provided the second and the committee unanimously approved the motion.

B.   Items for Discussion:

  1. Draft Updated Apex/Site 14 Water and Sewer Extension Policy (PAC10-01) Mayor Harold Weinbrecht moved to approve the Draft Updated Apex/Site 14 Water and Sewer Extension Policy.  Mayor Sears provided the second, and the committee unanimously approved the motion.
  2. Stream and Wetland Mitigation Plan (PAC10-02) Mayor Dick Sears moved to approve authorizing the Lead Agency to proceed with implementation of the proposed Mitigation Plan, including entering into a cooperative agreement with Progress Energy.  Mayor Harold Weinbrecht provided the second and the committee unanimously approved the motion.

C.  Other Business – none

D.  Closed Session
Mayor Weinbrecht moved for closed session for the following purpose; Mayor Sears provided the second; and committee granted unanimous approval.

Closed session was called pursuant to G.S. 143-318.11(a)(3) to consult with attorneys employed by and/or retained by the lead partner in order to preserve the attorney-client privilege between the attorneys and the Western Wake Partners. 

E. Mayor Harold Weinbrecht moved the Policy Advisory Committee authorize Cary to retain the services of John Cooke of Womble Carlye Sandridge & Rice, PLLC for legal advice as needed.  Mayor Sears provided the second; and committee granted unanimous approval.
